More Spammed Against Than Spamming!

Well as blog moderator on here I have never had to delete a comment before.

 

Anybody who does read the stuff on here will know that we intend it to be about giving information first.

 

There is a small part of self interest, yes. One, we use this (and other blogs) as a means of increasing SEO backlinking; and Two, we feel that if you are interested in what we've said then you might want an easy way to contact us for advice. (We offer 30 minutes FREE by the way - worth £137. Now there's another shameless plug, huh?)

 

The "writer" (who I assume was a disgruntled Will writer, such was the disproportionate and wounded tone) was writing from a server based in the Netherlands to say he had used [unqualified and unregulated] Will writers and they were fantastic as opposed to bona fide solicitors (with years of training, indemnity insurance and robust regulation regime and trade body).

 

Now everyone is entitled to their opinion.

 

Not everyone likes lawyers, clearly! (If you'd like some good "lawyer jokes" sprinkled in these posts, we have plenty! :  ) And we're not afraid to laugh at ourselves - at least not at this firm.)

 

But this article simply quoted a Law Society study, along with a comment from the solicitor at MenCap, which showed conclusively that unregulated and unqualified people make mistakes, and when you're talking about depedants and Wills these mistakes can be very expensive.

 

Hardly a surprising conclusion, you'd think!

 

In fact, the real problem, as highlighted by the study and our post, is that in the arena of Wills such incompetence can cause a breathtaking amount of anguish for those relying on faulty or negligent Wills. In such scenarios it is no use to go back to unregulated and uninsured people to complain - it is much too late then!

 

Here are some more

facts.

 

This firm charges £95 for a standard Will and £165 for a couple (with "mirror wills"). We then simply charge £100 for the first trust and following that, £50 for subsequent trusts. We also give 50% of the total fee to CHARITY!

So… We don't make any profit on Wills - in fact we often make a loss with time we spend to make things watertight. (We want to keep costs as affordable as possible because having a Will protects our clients, and protecting our clients is our job! And we see the loss-leader element of this as a generator of goodwill so our happy clients come back to us for other things, and we're proud to be able do something good for charities and the local community.)

 

Today, a quick ring around local "Will writers" gave quotes of £105 - £290 for a standard Will although they were all very reluctant to talk about the costs of trusts – the bad ones prefer to visit you in your home and build a sense of obligation (like double glazing salespeople).

So that means they are more expensive than a typical lawyer, with none of the advantages of using a solicitor, and with none of the money benefiting any charity either!

If you use such Willwriters, all this for work, in the end, is very much "at your own risk" no matter what you end up paying the Will writer.

 

So - as per our previous article -

do be very careful when you are making a Will.

 

There are a few good Will writers, no doubt with reasonable fees. There are a few bad solicitors, some with very high fees. You need to get the right advice at a fair cost.

 

So... Shop around by all means. In fact you should definitely shop around!

A few phone calls and maybe a visit or two to a website to look at testimonials from satisfied clients will most certainly pay dividends.

 

How else would you get a feel for what is a fair price for what you want and a good idea of the kind of person you're going to engage to do this really important work for you?

However, at all times, please do also remember you are providing for those you love the most.

 

Surely it makes sense to be certain the person arranging your affairs is the best and most qualified person you can find? Surely it's also a comfort to know for sure that things so arranged are very unlikely to go awry? Making a Will is about having peace of mind. You want to know everything is settled exactly as you want it to be. No surpises. No Mess ups.

 

Your peace of mind is all about knowing your loved ones will have the minimum of fuss and anguish.

 

And isn't it part of having your peace of mind that your nearest and dearest can have some guaranteed redress instead of being left in the lurch or destitute if something does go wrong?

That was the point of the previous article – to say "tread with caution, and make sure you get what you need, preferably with a guarantee".

I think that is just common sense, personally…

 

Or you could simply hope for the best and use a "Will writer" (and usually pay more for the dubious "privilege").
